For full transparency, please know that although the MSA team owns copyright on any art we make with MidJourney, they also have usage rights as stated below.
This is a new and growing field in copyright law, the waters are murky!
Rights given to Midjourney AI
“By using the Services, you grant to Midjourney, its successors, and assigns a perpetual, worldwide, non-exclusive, sub-licensable no-charge, royalty-free, irrevocable copyright license to reproduce, prepare Derivative Works of, publicly display, publicly perform, sublicense, and distribute text, and image prompts you input into the Services, or Assets produced by the service at your direction. If you are subject to a corporate license, or bought a privacy add-on to your subscription, we agree to make best efforts not to publish any Assets.”
In theory there could be duplicates of the original file created legally by Midjourney based on these terms, unlikely to happen though.
Our MJ membership is private, as stated above, so that our artwork is more protected and exclusive.
Any AI images that we alter in PhotoShop become ours exclusively.
